Duties Description The duties of the Administrative Law Judge (ALJ) in the Office of Administrative Hearings (OAH) are as follows, but not limited to:• Conducts hearings via WebEx.• Administrative Law Judges, under the direction of the Chief Administrative Law Judges, adjudicate all hearing types remotely, using laptops, equipped with microphones, and cameras.• ALJs will not physically appear at the OAH Offices. • ALJs conduct fair and impartial quasi-judicial hearings and write decisions in cases involving the professions and occupations regulated by the Department of State.• The areas of jurisdiction, which exceed 30, include, but are not limited to:o Real Estate Brokers/Salespersonso Cosmetologists & Barberso Appearance Enhancement Business Ownerso Notaries Publico Security Guards & Private Investigators• ALJs conduct research, rule on motions, receive and develop evidence, elicit testimony, and issue final decisions.• They apply the appropriate laws, regulations and policy to the facts and evidence.• ALJs write decisions which must be legally supported, as well as written in language accessible to self-represented litigants, attorneys, and the general public.• As an ALJ, you will support OAH’s commitment to expanding access to justice for all New Yorkers.
Minimum Qualifications A license to practice law in the State of New York, which must be maintained for the duration of service as an Administrative Law Judge (ALJ) for the Office of Administrative Hearings (OAH). Five years of recent relevant post-bar legal experience. Two years of experience as an Administrative Law Judge or Hearing Officer. Proficiency using video conference platforms like Zoom or WebEx. Reliable internet access in order to conduct remote hearings.
