Assistant Corp Counsel 4-Real Estate and Commercial Division
DescriptionAssistant Corporation Counsel 4 will provide legal representation and consultation to the County, elected officials, as well as County departments, boards and Commissions. Duties include legal representation of Wayne County in judicial and administrative proceedings; handling matters assigned by supervising attorney; attending County Commission and Committee meetings as required; interacting with outside counsel as required; completing administrative and reporting responsibilities as required.Purpose/DescriptionAssistant Corporation Counsel 4 will provide legal representation and consultation to the County, elected officials, as well as County departments, boards and commissions. Duties include legal representation of Wayne County in judicial and administrative proceedings; handling matters assigned by supervising Chief Assistant Corporation Counsel; attending County Commission and Committee meetings as required; interacting with outside counsel as required; completing administrative and reporting responsibilities as required.Required TasksLegal Oversight of Grant Management and Compliance - Review and interpret grant requirements, regulations, and restrictions; draft compliant agreements that ensure that sub-recipients and developers perform and that secure the County's interests; manage and resolve issues that arise with sub-recipients, program managers, and developers; assist with audits and monitoring reviews.Legal Oversight of Real Estate Transactions - Conduct review, drafting, and oversight of leases, purchases, sales of excess real property, easements, and right of ways. Advise on non-traditional transaction structures; advise on permits and restrictions of use for propertiesLitigation Prevention - identify and analyze potential liability for assigned clients (DPS, WC Real Estate Clients) and advise on avoidance and mitigation mechanisms (i.e. contracting, security, mediation, policy/rule changes, communication, processes).Legal Oversight of Right of Way Issues - advise on specialized issues related to the County road and right of way system including permits, insurance, encroachments, easements, intergovernmental agreements, liability, maintenance, funding and jurisdictionLegal Oversight of Procurement Issues for Assigned Clients (DPS) - Advise on best procurement strategy; Draft and review RFP's; Attend evaluation meetings and advise on compliance; draft agreements; assist with answering proponent questionsAssist with Legal Oversight of Major Construction Projects - Assist Chief Assistant Corporation Counsel and Principal Attorney with contract review, notices to vendors, and review of real estate issues surrounding such projects.Draft, review and oversight of contracts for the County, including the CJC and Buildings Division.Interface with utility companies and consultants on various matters.Conduct legal research and preparation of summaries, memos and discovery to advocate the County's position on these issues as requested.With some supervision, handle state and federal court litigation.Provide direct and regular communication to client and supervisors as to case status and gives risk/benefit analysis & recommendations throughout the legal representation.Conduct legal research and other research.Read and understand case law and statutes thoroughly issue spot and critically analyze facts and their application to legal precedent.Appear in Probate Court for mental health docket which includes bench trials and jury trials for civil commitment hearings.Attend regular team meetings.Support non-departmental administrative and other responsibilities necessitated by client department needs.Attend legal seminars and in house training, as approved by supervisor.Conduct and respond to legal discovery.Prepare reports for clients and outside agencies.Prepare quality well-written, well-researched pleadings, motions, briefs, summaries, memoranda of law, legal opinions, and correspondences.Serve as counsel to departments and agencies, gives legal advice to the departments and agencies daily.Attend meetings, including client meetings, board meetings, commission meetings, department meetings, internal staff meetings, and appears before the Board of Commissioners when necessary.Maintain proficiency and keep current all assigned matters in Prolaw (or other case management system).QUALIFICATIONSEducational RequirementsJuris Doctorate and continuing legal education in assigned practice area.State Bar of Michigan license and admission to State and Federal courts as necessitated by practice group requirements.Experience RequirementsMinimum four years prior experience in assigned practice area
