Summary Assistant Director, Procurement Compliance The NJ TRANSIT Procurement & Logistics Department is constantly leaning into our vision to cultivate an inclusive best- in-class organization of responsible stewards that employ strategic, efficient, and transparent processes to fairly source and manage goods, equipment, and services, thereby propelling NJ TRANSIT in its mission. This managerial procurement position may supervise procurement professionals and leads and follows the evolving regulatory environment and advises the Procurement & Logistics Department staff and clients to maintain an efficient and compliant operation with respect to the activities and responsibilities of the department under the general direction of Procurement & Logistics Department senior management. The person in this position is self-directed, able to identify, evaluate and implement strategic solutions, and must be able to interact professionally with executive leadership. This position reports to a procurement Director. Assistant Director, Procurement Compliance Research + Researches local, state, and federal statutes, regulations, and case law to support the Procurement & logistics Department. + Monitors, reviews and coordinates Procurement & Logistics position and interests with respect to proposed legislation affecting assigned program areas. Provides impact analysis of pending legislation to the Director of Regulations, implementation guidance of enacted legislation, and assists with or leads the development of the proper adjustments to business processes, tools and documents. Prepares draft regulations to support the effective and efficient procurement of services and supplies to support the mission of the corporation. + Analyses, develops and presents public policy issues for internal consideration and prepares items for potential external consideration including responses to statutory/regulatory mandates. Procurement & Contract Management + Supports business units in drafting legal justifications for procurements-by-exception. + Collaborates with Law Department to determine whether proposal and bid materials are exempt from public disclosure under OPRA. + Directly monitors and manages procurement compliance with federal, state, and other regulatory frameworks in Procurement packages. Ensures procurement compliance with NJ TRANSIT’s own policies and procedures. + Provides guidance to other NJ TRANSIT business units, Procurement Department staff, including the Senior Director of Contracts and Senior Director Purchasing, on procurement strategies and best practices. Department Compliance + Tracks Procurement & Logistics Department compliance with federal and state regulations. + Leads, in consultation with the Chief Procurement Officer, Director Procurement Compliance, and the Compliance Office, the Department’s responses to oversight, audits, and other inquiries. + Advises Procurement leadership and directs staff in the management of oversight, document control, training, and planning functions. + Plans, revises, and updates standard templates (e.g., contract, solicitation, and other associated document) on a planned basis, updating as necessary to ensure compliance with state and federal law, and to ensure documents and procurement processes reflect sound public policy. This will be done in a structured way to assure compliance and maximize business efficiency. + Assists the Director of Regulations in policy planning, development, and implementation. Systems of Record + Assures all work is conducted within the currently approved systems of record or, where manual processes are employed, that documents are properly maintained in conformance with document control policies. + Within the parameters established by the Director, Procurement Support, develop compliant content (such as standardized templates) for Systems of Record for the Procurement & Logistics Department, including departmental support and training. + Provides feedback and input on planned or new systems. Training + Seeks out and gains training to increase proficiency in procurement, statutory and regulatory framework for public sector procurement, procurement and contract law, and developing and aligning in-line efficient process with the appropriate policies, regulations and statutes. + Assures that departmental staff are current with all required training. Develops and or delivers training where needed to advance the compliance, transparency and efficiency of the department. + Assists the Director of Regulations in planning and leading federal and state procurement process training of the Department and the Corporation. + If the Assistant Director has assigned direct reports, assures all members of the team have Development Plans, Goals, and Rated Accomplishments Protests & Appeals + Tracks, researches, and advises Procurement leadership on procurement appeals and protests. This includes researching statutes, regulations, policies, by-laws, case law at the state and federal level to draft documents regarding agency decisions. Leadership + Represents the Director, Regulations at external meetings, task forces, working groups or committees, as needed. Coordinates activities of importance, tracks priority issues and ensures proper follow-up coordination. + Coaches, advises, and mentors department personnel with respect to matters of compliance affecting the Department. + Reviews, corrects, and provides feedback on work performed under Assistant Director’s direction by assigned or other contributors. + Collaborates with and advises colleagues on a regular basis to continuously improve the Procurement & Logistics Department. + Provides advice to the leadership of the Procurement & Logistics Department as a member of the Procurement & Logistics Management Team. Other Responsibilities + Collaborates with customers and client departments on their procurements with respect to matters of compliance. + Develops and maintains professional working relationships between the Manager’s team and key business partners to fully understand business needs, plan for future work, advise on procurement compliance, and mitigate interdepartmental problems. + Considers and promotes strategic solutions to create efficiencies and greatest value for NJTRANSIT and promotes DBE considerations in such Strategies. + Works on special projects assigned by the Director or Senior Director. + Performs other duties as assigned by Procurement Leadership This Position Supervises: + Compliance Specialist, Sr. Compliance Specialist, Lead Compliance Specialist Education, Experience, and Qualifications + Bachelor's degree in business, political science, economics or related field. + Fine (5) years of relevant compliance and/or procurement experience. + In lieu of 5 years relevant compliance and/or procurement experience will consider candidates with a Law degree and 1 year of related experience. + Procurement experience preferred. + Experience managing others preferred. + Government sector experience preferred. Knowledge and Skills: Assistant Director, Procurement Analyst Technology – Must be able to work proficiently in the following Systems of Record: ECMS, Microsoft Office Suite (Outlook, Access Databases, Excel Spreadsheets, Word, PowerPoint, Project, Teams), Adobe, Oracle ERP, Kronos, Bid Express, and other systems in use or under development. Systems may change over time. Communication Must be able to perform active listening and have excellent written and verbal communication skills required. Must be able to develop and deliver executive and board level presentations. Leadership A demonstrated track record of interacting with executive leadership and managing other professionals is required. Procurement & Compliance + Must be proficient in Contract Writing and Negotiations. + Must understand the regulatory and statutory basis for public procurements. + Dispute resolution, claims negotiation, or contract litigation and fluency with state and federal procurement laws and regulations are required.
