Yes County Albany Street Address 800 North Pearl Street City Albany State NY Zip Code 12204 Minimum Qualifications Preferred Qualifications: Admission to the New York State Bar and a member in good standing with at least six years post NYS Bar admittance legal experience as a practicing attorney in litigation and/or in administrative proceedings. Applicants must have prior supervisory experience and be capable of managing a legal office of attorneys and support staff. Knowledge and experience with NYS legislative or regulatory processes are a plus. Duties Description Reporting to the General or Deputy Counsel, the Associate Counsel provides high-level support, legal assistance, and advice to the Medicaid Inspector General, the General Counsel, legal staff, and other members of the agency’s executive team at the policymaking level regarding legislative and regulatory matters and complex litigation that may impact the Medicaid program. Litigation work will include cases in state and federal court, and cases of first impression or novel issues related to Medicaid, health law and Managed Care. Additionally, the Associate Counsel may act as the agency Ethics Officer or as an Appeals Officer for one or more legal subject areas. Provides legal support of the agency and its operations as part of the Office of Counsel (OC) management team. Specific duties include, but are not limited to:• Provides legal support for the development and implementation of proposals to amend the State’s legislation, regulations, or one of the components of Medicaid Managed Care contracts: o Conducts research, reviews, and provides legal analysis of legislative proposals, including justification, impact to program integrity, metrics and statistical data, fiscal impact. o Communicates and collaborates, as appropriate, with other impacted stakeholders in determining impact of proposed legislation. o Provides legal opinions and suggest changes where appropriate. Analyzes impact where legal precedent is unclear. o Participates in discussions to determine impact to agency operations, feasibility, etc., and makes recommendations to executive team to advance viable proposals. o Drafts legislation and guides proposals through the legislative process. o Provides legal support in implementing adopted legislation.• Researches and analyzes legislative issues or external proposals that impact the Medicaid program and agency operations: o Provides analysis and interpretation of existing laws and regulations, particularly in new/emergent areas. Analyzes proposed or new legislation, directives, and/or policies for impact on agency policies, practices, and operations. o Conducts legal research of statutes, decisions, opinions, and other sources to respond to requests and inquiries. o Distills and communicates legislative information to agency staff. o Provides coordinated agency feedback to internal and external stakeholders.• Serves as agency Ethics Officer:o Provides guidance and advice to agency staff on ethics questions/issues, compliance with ethics laws, rules, regulations, and agency policies. o Acts as liaison with Commission on Ethics and Lobbying in Government (CELG) to communicate agency compliance, receive updates and disseminate to staff. o Ensure training for agency staff is scheduled and conducted; participate in the delivery of training. • Participate as a member of the OC management team:o Supervise attorneys and other staff within the Office of Counsel. Perform supervisory functions, such as assigning work, managing workload, preparing evaluations, approving time off. o Reviews work from staff members for quality; ensure agency’s perspective, policies and goals are considered and supported.o Offers legal opinions and make recommendations to agency staff from various program areas; ensure agency actions are legally supported. o The Associate Counsel may also be assigned to other program areas or special projects as needed and at the discretion of the General or Deputy Counsel.o Represent the agency at internal and external meetings. o Make presentations at executive team meetings or in other forums on legal issues related to Medicaid program integrity and/or agency operations. Additional Comments Full-time, exempt. Salary within the posted range will be commensurate with experience. This is an appointment to a position in the exempt jurisdictional class. All exempt appointments require completion of a background check prior to appointment, and completion of an annual Financial Disclosure Statement. Incumbents serve at the pleasure of the appointing authority, and the employment relationship can be altered at any time by either party.
