Position Description: As an in-house Benefits Attorney for a national PEO, you will be an integral part of our Legal and Compliance team. You will provide legal counsel on employee benefits, executive compensation, and related compliance matters. This role will be responsible for advising on ERISA, the Affordable Care Act (ACA), HIPAA, COBRA and other federal and state laws affecting employee benefits. The ideal candidate will work closely with our Benefits and Retirement teams to ensure compliance, risk management, and strategic planning for benefits programs.
Roles & Responsibilities:
+ Provide strategic guidance and legal counsel on employee benefits matters, including health and welfare plans, retirement plans (401(k)), and executive compensation.
+ Ensure compliance with ERISA, ACA, HIPAA, COBRA, IRS, and DOL regulations, as well as applicable state laws.
+ Advise on compliance-related aspects of insurance plan designs, administration and governance, ensuring alignment with business goals and regulatory requirements.
+ Draft and review benefits-related policies, contracts, and plan documents, including summary plan descriptions and amendments.
+ Oversee benefits-related audits and legal matters, as needed.
+ Monitor legal and regulatory developments in employee benefits law and provide guidance on necessary adjustments.
+ Assist in M&A transactions by conducting due diligence and advising on benefits related issues.
+ Represent the Company at industry events and on industry committees as may be applicable.
+ Respond to inquiries from government agencies regarding benefits matters as needed.
+ Other duties as assigned.
Education & Experience Qualifications :
+ Juris Doctor (J.D.) from an accredited law school.
+ CHC, CCEP, CHPC, and/or other relevant certifications highly regarded.
+ Admission to practice law in at least one U.S. jurisdiction.
+ Ability to register as in-house counsel in New York.
+ 5+ years of experience in employee benefits law, either in-house or at a law firm.
+ Strong knowledge of ERISA, tax laws, and other benefits-related regulations.
+ Professional employer organization/employee leasing experience a plus
Skills and Personal Qualifications:
+ Strong contract drafting and negotiation skills.
+ Ability to manage multiple priorities in a fast-paced environment.
+ Excellent communication and interpersonal skills.
+ Solid knowledge of Microsoft Office applications, including, but not limited to, PowerPoint and Word

Salary range based on Experience and location up to $175K
