Responsibilities

The Claims Attorney is a licensed attorney who provides expert legal support and advice on how to mitigate the liability and future exposure of MECC and its insureds on workers’ compensation and employers’ liability claims.  The Claims Attorney serves as an expert resource for the Claims Department and Regional Teams and provides guidance on claim issues such as settlement, Medicare compliance, insurance coverage, litigation strategy, third-party recovery and employers liability.  The Claims Attorney works in collaboration with internal Claims Department personnel (Claims Analyst and Medical Management Consultant and Claims Management) and external stakeholders (defense attorney, TPA and self-insured employer) to influence manage the outcome of claims with varying degrees of complexity, in various jurisdictions. 

 

Key functions include but are not limited to:

Appropriate handling of legal referrals, including:Timely review and management.Keeping referrals on active diary.Displaying quality legal analysis, strategy, and action plan.Appropriate file documentation and communication (internally and externally).Supports the Analysts and Regional Teams with the settlement of claims by:Proactively identifying claims that are ripe for settlement.Assisting with case evaluation and settlement strategy.Communicating settlement strategy with external stakeholders (TPAs, insureds, defense attorneys, etc.).Actively assisting with the negotiation process, attending mediations when it makes sense to do so, and doing what is necessary to close deals.Having demonstrated a track record of settling cases at the right price and terms.Being a resource internally and externally on Medicare issues that impact settlement and the different types of settlement vehicles/methods available.Instituting referrals to MEC’s settlement counsel when appropriate.Keeping abreast of various drivers that affect settlement (jurisdictional, legal, medical, etc.) and educate internal and external stakeholders.Interfaces with and manages external resources, including outside counsel retained by MEC.Responsible for monitoring various developments in the legal environment and excess workers’ compensation marketplace; education of Claims, Underwriting, and external stakeholders of jurisdictional and industry trends.Interaction with MEC clients and their representatives according to the MEC brand and the Claims Department vision.Serves as a go-to resource and subject matter expert for MEC and its insureds on jurisdictional and industry specific issues.Acts as a leader, mentor, and positive influence on others in the Claims Department.Develops solutions and new strategies to mitigate loss.Operates independently, executing plans under minimal supervision.Other duties as assigned by the Chief Claims & Regulatory Counsel or Vice President of Claims. Qualifications Juris Doctorate degree from an accredited law school.Active bar license in at least one state.Minimum of 3 to 5 years of relevant legal experience handling workers’ compensation claims, auto/general liability injury claims, insurance defense, insurance coverage, and/or litigation.Experience negotiating high exposure claims involving Medicare issues.Demonstrates sound legal analysis and judgment.Excellent written and oral communication skills.Demonstrates the ability to influence manage internal and external stakeholders.Adept at negotiation.Excellent listening and interpersonal skills.Keen attention to detail.Demonstrates proficiency in the use of Microsoft Office products.Ability to work in a team-oriented, collaborative environment.Highly self-motivated and directed.
