Clinical Care Investigator

The Board of Registration and Medicine within the Department of Public Health (DPH) is seeking anexperienced Registered Nurseto evaluate complaintsagainst physicians and identify those allegations that raise issues of substandard care.

The Clinical Care Investigator will identify andobtain appropriate medical records to review,analyze, and summarize. The Investigator willwork with complaint counsel to identify relevantwitnesses and conduct interviews as determinedby the team, and also identify and interviewphysicians who will act as experts. The incumbentorganizes and prepares materials for expertreview; writes clear, concise and logicallysequenced memoranda; and assists complaintcounsel in the preparation and presentation ofadjudicatory matters before the Board and theDivision of Administrative Law Appeals (DALA).

Duties and Responsibilities (these are ageneral summary and not all inclusive):

Reviews and investigates complaintsand reports from patients, individuals,mandated reporters and other sourcesto determine potential violations oflaws, regulations or standards ofmedical care affecting the publichealth, safety and welfare. Identifies those allegations that raise issues of substandard care requiringfurther investigation; proceedsaccordingly by requesting medicalrecords and/or interviewing witnesses;maintains a record of interviews andprepares investigative reports in atimely manner; maintains activity logsdocumenting case work.Oversees a caseload by prioritizingwork appropriately, setting andachieving goals and responding todeadlines in a timely manner.Prepares accurate, objectivesummaries of medical records for useby complaint counsel and Boardcommittees; provides clinical analysisof consumer complaints and statutoryreports, drawing on medicalknowledge andexperiencetodetermine whether care wassubstandard.Analyzes consumer complaints andstatutory reports, evaluates physicianresponses and reviews relatedmedical records; preparesmemoranda containing an analysis ofthe medical issues and recommendsdisposition.Works collaboratively with complaintcounsel and investigators in thedisciplinary processing of a case;summarizes medical records andprovides education on the medicalissues; identifies additional medicalrecords and materials to besubpoenaed and persons to beinterviewed; gathers and analyzesrelevant medical literature.Identifies and interviews qualifiedphysicians who are willing to providean expert opinion on the quality ofcare provided in a particular case;organizes materials for expert reviewand assists complaint counsel ininterviewing expert witnesses andpreparing experts for hearing, asneeded.Assists complaint counsel in thepreparation of legal documents suchas a subpoenas, affidavits, Statementof Allegations, Consent Ordersandmemoranda on disposition.Assists complaint counsel in thepreparation and presentation of casesat DALA, as well as at depositionsand pre-trial conferences; attendshearings and/or gives sworntestimony at hearings as necessary;assists complaint counsel in thepreparation of questions and exhibitsto be used at hearings.Adheres to strict legal and regulatoryrequirements of confidentiality andprohibitions against unauthorizeddisclosure of sensitive, confidentialand privileged information regardingpatients, physicians and lawenforcement investigations.Attends relevant training as requiredand keeps abreast of relevantnursing/medical practicedevelopments.Conducts self professionally inadherence to Massachusetts law,Board regulations, policies,procedures and protocols and incompliance with the American NursesAssociation Code of Ethics forNurses.Maintains productive workingrelationship with all levels of Boardstaff.

Required Qualifications:

Demonstrated knowledge of thestandard nursing policies, procedures,methods, and investigativetechniques.Proven ability to understand, interpret,apply and explain the principles andpractices of medicine.Capacity to analyze and interpretmedical records, legal documents andsummarize different types of medicalinformation.Ability to write concisely, to expressthoughts clearly and to develop ideasin logical sequence.Talent for communicating effectively inverbal and written expression.Skilled in exercising sound judgmentand discretion in handling confidentialinformation.

Preferred Qualifications:

Ability to identify the critical issuesthat are inconsistent with the standardof care.Familiarity with the legal andregulatory issues that impact medicalcare.Ability to establish effectiverelationships with individuals,physicians and staff.Motivated, self-directed, detail orientedand able to work wellindependently or with a team.Proficient usage of Microsoft OfficeProducts including Word, Excel,Power Point and outlook.
