Code Compliance Officer

The Department of Fire Services (DFS) is seeking qualified professionals for the position of Compliance Officer II. There are currently two positions available within the Code Compliance Enforcement Unit (CCEU). We have offices located in Stow, Bridgewater, and Springfield. Compliance Officers are assigned to one of four regions within the Commonwealth. Based on assignment needs, the position may be required to travel statewide.

Work hours are 8:00AM - 4:00PM, Monday through Friday. After hours stand-by (on-call) time is required every two to five weeks. Must be available to work varied shifts, weekends, holidays, nights, as required.

Compliance Officers respond to inquiries from local fire departments, members of the industry and the public regarding the Fire Prevention Regulations by providing information, interpretation, advice and technical support to encourage voluntary compliance and to increase fire prevention and fire protection. Performs investigations of non-compliance with M.G.L. Chapter 148, CMR 502, 527 CMR 1.00, M.G.L. Chapter 64C, section 2A-2F. Obtains evidence (including on-site inspection), establishes facts, generates reports, issues orders to correct violations and follow through of enforcement of the violation; and performs related work as required.

Pre-Employment Requirements - Recommended candidates must pass a pre-employment screening which includes a criminal records check through the Massachusetts Department of Criminal Justice Information Systems (DCJIS).

DETAILED STATEMENT OF DUTIES AND RESPONSIBILITIES

Responds to inquiries from local Fire Departments, members of the regulated community and the public regarding the Fire Prevention Regulations and related statutes by providing information and technical support, interpretation on applicability of rules and regulations and related statutes, advice on proper procedures to be followed, to encourage voluntary compliance and to increase fire prevention and fire protection. In the event voluntary compliance cannot be achieved, appropriate enforcement action up to and including court action.Responds to fire (including those involving fatalities), explosion, and hazardous material incident scenes and works independently and in cooperation with the appropriate agencies for investigation, compliance and enforcement action regarding violation of law and regulation. The Code Compliance Enforcement Officer (CCEO) must be able to evaluate for potential hazards, including but not limited to: structural collapse, undetonated explosives/fireworks, hazardous by-products of combustion, exposure to hazardous materials in the form of liquids, gases and solids; in order to choose the appropriate personal protective equipment to enter the scene. Determine violations of law and/or regulations; document incident scenes through reports, photographs, site measurements, mapping etc., collect and secure evidence, conduct interviews. Work with appropriate agencies, if necessary, for enforcement action (including but not limited to: district attorney, attorney general, inspector general, law enforcement and clerk magistrates).Testify at administrative hearings, depositions, probable causes hearings, grand jury proceedings, civil and criminal trials.Investigate, and where appropriate, work with local fire departments on preparing and submitting cases for license suspension and/or revocation hearings, as well as prosecute licensing suspension and/or revocation cases on behalf of the CCEU before a designated hearings officer. Function as resource and liaison to local fire departments on behalf of the Department of Fire Services.Work with the State Police Fire and Explosion Investigation Unit as necessary and as requested.Follows standard operating procedures (SOP) for performing and scheduling on-site visits; maintains accurate and complete compliance log, as required by policy (electronic vs. paper) in a timely manner.When attempts to gain voluntary compliance fail, follow SOP with Notice of Violation, Order of Notice, and finally, prepare complaint for court of jurisdiction.Prepares concise written investigative reports relative to inspections and investigations for presentation to agency staff, state, federal agencies, and courts.Conducts training programs for staff, fire service personnel, and members of the regulated community regarding regulatory and statutory requirements.Investigates complaints of violations of statutes, rules and regulations under the control of the State Fire Marshal (M.G.L. Chapter 148, 502 CMR 5.00, and 527 CMR 1.00, M.G.L. Chapter 64C, section 2A-2F); obtain evidence and establish facts concerning complaints and alleged non-compliance.Performs regular inspections of fireworks displays, blasting sites, and explosive storage facilities for compliance with applicable laws, regulations and, where appropriate, strict inventory control (which may include counting cases of explosives and detonation systems).Responsible for the inspection of above ground storage tanks exceeding 10,000 gallons.Represents the Office of the State Fire Marshal at meetings and conferences as necessary.Inspects DFS regulated industry locations, such as fixed marine fueling and fire suppression facilities.

Minimum Entrance Requirements: Applicants must have at least (A) three years of full-time, or equivalent part-time, experience in investigatory, law enforcement or regulatory administration work, or (B) and equivalent combination of the required experience and the substitutions below.

Substitutions:

A Bachelor's or higher degree may be substituted for a maximum of two years of the required experience.

Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.

PREFERRED QUALIFICATIONS

Knowledge of the methods of general report writing, and ability to prepare general reports.Knowledge of M.G.L. Chapter 148, M.G.L.
