Yes Job Summary The Procurement, Contracts and Materials Management ( PCMM ) is seeking up to two Construction Contracts Officers. These are full-time (1.00 FTE ),12-month, professional faculty positions. Construction Contracts Administration ( CCA ) manages the procurement of goods and services necessary to construct, protect, repair, maintain, and preserve the physical facilities, infrastructure and utility systems of the University. CCA provides solution oriented, timely, effective, and professional procurement services that enhance the instructional, research, and service goals of the University. The Construction Contracts Officer reports to the Construction Contracts Manager and is responsible for coordination and management of competitive solicitations for contractors and consultants, and the development and management of contracts to ensure high quality delivery for each project. Procurement, Contract Services, and Construction Contract Administration ( CCA ) assists, advises and provides oversight to OSU Colleges and Departments in meeting their procurement and contracting needs. Campus Recycling develops and maintains cost effective and efficient waste management that focuses on reducing, reusing, and recycling with disposal as a last resort. Surplus Property recycles or transfers surplus property back to OSU departments, state and local governments, qualified nonprofit organizations, and the public. Procurement, Contracts, and Materials Management is a unit within the Senior Associate Vice President of Administration’s division, which reports to up to the Division of Finance and Administration ( DFA ) at Oregon State University. Key Responsibilities 65% Procurement, Contract Administration and Management The Construction Contracts Officer provides administrative and professional management for solicitations and acquisitions of construction and design services. This includes drafting complex multiphase agreements, approving construction contracts, and overseeing contract administration of the project from inception through closeout. The Construction Contracts Officer conducts timely and comprehensive reviews of change orders and amendments and supporting documentation to ensure compliance. The Construction Contracts Officer ensures contracts are submitted to General Counsel for legal review in compliance with University policy when appropriate. Works with General Counsel to address issues identified by General Counsel regarding compliance with the policy to get contract into acceptable form. Exercises a high level of discretion in all matters especially in communications regarding sensitive and confidential information. This position interprets and applies statutes, regulations, and policies as applicable to solicitations and contract documents. Determines and drafts appropriate solicitation delivery method documents to comply with applicable requirements while meeting business objectives. Utilizes creativity and innovation in developing solutions to unique solicitation and contract needs while maintaining necessary compliance with applicable rules. Evaluates responsibility and responsiveness of offers submitted. Works with Chief Procurement Officer and CCA Manager to determine validity of appeals. BOLI Compliance: Ensures appropriate language is included in project solicitations, contracts, change orders and other construction documents. Collaboratively works with project managers and construction managers ensuring project and budget compliance. Analyzes work contemplated for the University to determine whether specific projects and sites are subject to Bureau of Labor and Industries ( BOLI ) jurisdiction and ensures University compliance with Prevailing Wage Law ( PWL ). When applicable, ensures compliance with Davis Bacon federal prevailing wage requirements and make Davis Bacon wage determinations, ensures language provisions included in solicitations and contract comply with federal procurement rules. Insurance/Bonds: Requests, collects, analyzes, and maintains all necessary contract submittals including bonds and insurance documentation. File Maintenance and data entry: Maintains complete, accurate and up-to-date documentation and information, in project contract file. Performs necessary data entry to maintain and update appropriate project information, including data capturing time and effort and other project costs in project management systems (eBuilder). In addition to eBuilder, the Construction Contracts Officer utilizes and assesses varying University systems, software programs and databases to perform the work including but not limited to an eProcurement system (currently Jaggear), insurance tracking software and University built programs for solicitation advertising, Reserve Contract, workflow and others. 15% Communication and Collaboration Foster, manage and maintain effective relationships through collaboration and professional communication practices. Disseminate information regarding departmental operations, solicitations, procurements and contracts. Manage all activities related to procurements, including but not limited to, scheduling, facilitating and leading pre-proposal and pre-bid meetings, meetings with selection/evaluation committee, contract negotiations and contract administration and contract life-cycle meetings. In consultation with the Construction Contract Manager: 1) communicates effectively to provide timely response to inquiries related to contract status and to avoid delays to the project schedule; and 2) analyzes contract administration problems such as delays, contract disputes, and workflow to recommend resolution strategies to the Construction Contract Manager. Works closely and collaboratively with Project Managers and Construction Managers to build and maintain a collaborative team environment. 15% Construction Contracting Policy, Procedure, Operational Improvement Provides recommendations to the Construction Contracts Manager for improvements and revisions to policies and procedures and for adjustments to work unit’s operations to meet changes in needs, requirements and University resources. Manages implementation of approved improvements and revisions. In consultation with the Construction Contracts Manager, updates operational procedures and contract documents, documenting any changes or additions in the procedures manual and communicating clearly to fellow team members. Actively participates in process improvement activities. Contributes towards development of solicitations and contracting mechanisms including but not limited to contract language revisions and contract overhaul activities. 5% Outreach and Engagement Includes, but is not limited to, organizing and leading process reviews to identify and implement improvements, contributing to reporting and data collections. Participates in OSU Supplier Showcase (or similar events), University Day, Construction Industry Forum, diversity, equity and inclusion outreach and other business outreach activities as well as other training activities. Represents CCA by chairing or serving on committees as required. Other duties as assigned. What You Will Need + Three (3) years of professional construction contracting experience with an emphasis in contract administration for large-scale capital projects/programs; OR Three (3) years of professional procurement and contracting experience AND + Bachelor’s degree in a field related to assigned responsibilities; OR three (3) additional years of professional procurement and contracting experience, in lieu of a Bachelor’s degree + Experience with drafting complex solicitations including evaluation of responses. + Experience developing and managing professional construction and design contract and procurement documents, including, but not limited to new building construction, renovation and expansion. + Ability to analyze data and project information and to use professional oral and written communication with diverse relevant parties. + Experience implementing statute, rules, policies and procedures to support timely procurement and contracting. + Experience simultaneously managing numerous solicitations and contracts for a wide variety of projects. + Experience in regular and recent use of Microsoft Office software applications including Word, Excel, and Outlook or a proven ability to quickly master software applications generally used in the construction industry. + Commitment to supporting and participating in diversity and inclusion efforts in the work environment. What We Would Like You to Have + Experience working in Higher Education setting or public entity/agency in a procurement role or experience in contract administration for capital construction projects benefiting a public entity/agency. + Certificate from a professional trade organization, evidencing competency in preparing construction related documents and contracts. + Field Related Professional Certification. Universal Public Procurement Certification Counsel as a Certified Public Procurement Officer ( CPPO ) and/or Certified Public Procurement Buyer ( CPPB ) or Institute for Supply Management Certified Professional as a Certified Purchasing Manager (C.P.M.). + A demonstrable commitment to promoting and enhancing diversity, equity and inclusion. + Master’s degree of Business Administration or related field. + Experience working with contract law. + Experience in procurements subject to federal public procurement guidelines. Working Conditions / Work Schedule This role involves a combination of collaborative and independent work, it will take the form of a hybrid work format, with time split between working onsite and remotely. The hybrid schedule is dependent upon project needs. Work to include driving to off-site meetings, pre-bid/proposal walk through, and other contract related responsibilities, sometimes in adverse weather conditions.
