Director II, Compliance and Investigations

Summary Description:
Under direction of the chief of Human Resources and Development, oversees the Department of Investigations and Compliance; serves as Montgomery County Public Schools^ (MCPS) representative to Child Protective Services, local law enforcement and the State^s Attorney^s Office in matters related to employee conduct. The director leads and coordinates confidential, comprehensive investigations of all suspected, inappropriate, unprofessional, and/or criminal behavior, issues related to Title II, Title VII and Title IX, and underperformance of employees; prepares necessary correspondence, and maintains reports of the results of investigations. Oversees the ADA compliance director who leads department in work related to the assessment of job skills and accommodation of employees and applicants with disabilities Maintains consistent, clear communication, data and reporting with OHRD and other district leaders as required to ensure accountability and transparency. Works closely with schools on all matters related to employee discipline and performance. Ensures compliance with Montgomery County Public Schools policies and regulations, including the Employee Code of Conduct.Physical Demands:NoneSpecial Requirements:Availability to occasionally work weekends and evenings to make presentations, attend meetings, and complete investigations.

Knowledge Skills Abilities:
Extensive knowledge of the Americans with Disabilities Act (ADA), EEOC regulations; Title VII and Title IX and effective and comprehensive investigation practices; and extensive knowledge of federal and state laws related to employment and, Fair Labor Standards Act, HB486, child abuse and prevention laws. Thorough knowledge of Title IX and its applicability to sex discrimination and sexual harassment in a K-12 environment. Thorough knowledge of the Americans with Disabilities Act (ADA), EEOC regulations, Rehabilitation Act of 1973, knowledge of state and county retirement systems and MCPS policies and regulations. Knowledge of ADA interactive process and is able to determines ADA accommodations. Understands and is able to oversee the formal Title IX grievance process; investigation procedural requirements; is able to design and oversee thorough investigation plans; conduct trauma-informed interviews and guide investigators in best practices; and oversee/participate in the preparation of comprehensive and accurate investigation reports. Must have ability to conduct confidential investigations and provide written reports of findings. Must have thorough knowledge of and proficiency in the application of and compliance with federal, state, local law, as well as MCPS policy/regulations. Knowledge of Board of Education policies and regulations, state and federal laws, rules, and policies and procedures concerning the rights and privileges of employees including, but not limited to employment, tenure, performance evaluation, due process, and teacher certification. Extensive knowledge of the three negotiated agreements. Knowledge of progressive discipline process and performance improvement planning. Knowledge of school operations. Demonstrated conceptual, analytical, organizational, and management skills. Excellent communication and interpersonal skills. Knowledge and application of the six leadership standards that have been established for the Montgomery County Association of Administrators and Principals (MCAAP/MCBOA) Professional Growth System (PGS).

Education Training Experience:
Master^s degree from an accredited college or university in legal studies, criminal justice, risk management or a related field required. Possession of a juris doctorate degree from an accredited school of law highly preferred. A minimum of six years of experience in a compliance role, some of which includes leading an effective compliance investigations team for a large organization, preferably in a public school system. Must have proven experience in Title VII and Title IX investigations and navigating the formal grievance process under Title IX. Training or course work on ADA and considerable experience leading ADA work, including investigations and determining accommodations. Some supervisory experience required. Experience in a law enforcement or legal-related role highly preferred. Coursework and experience in human resources or administration preferred. preferred Other combinations of applicable education, training, and experience, which provide the knowledge, abilities, and skills necessary to perform effectively in the position, may be considered.Certificate License:Level I Title IX investigator certification or equivalent required or must obtain within 6 months of hire.
