SUMMARY OF POSITION:The Director of Environmental Compliance is accountable for the recognition, evaluation, and control of potential hazards to the environment, and for advising management of applicable Federal, State, and Local environmental regulations and their effect on operations within Marmon Rail.  This position has a direct impact upon Marmon Railt’s ability to clean and otherwise refurbish leased tank cars while protecting the environment.  This position serves to minimize the Company’s liability by ensuring compliance with all environmental regulations and policies.  This position supervises the activities of the Senior Environmental Engineer, two Sr. Environmental Compliance Specialists, and one Regional Environmental Manager.  In addition, the Director of Environmental Compliance serves as Marmon Rail’s Coordinator of Responsible Care and is responsible for implementing and maintaining the company’s Responsible Care program. NATURE AND SCOPE:This position reports to EVP, Technical Services. Marmon Rail’s Business consists of one (1) headquarters location, sixteen (16) major repair and lining facilities, and over fifty-five (55) mobile and mini-shops.  Each of the sixteen (16) major operating locations are capable of generating waste streams from general operations and railcar cleaning that require permitting and result in air, water, and or solid emissions/discharges.The following positions report to the incumbent under direct supervision:Senior Environmental Engineer(2) Sr. Environmental Compliance SpecialistsRegional Environmental ManagerThe following positions report indirectly to the incumbent:Sixteen (16) EHS ManagersThe chief concern of the incumbent is the development, implementation, and maintenance of effective policies and procedures to ensure the protection of the environment and ease of operations; thereby, minimizing Company liability, ensuring compliance with environmental protection regulations at Federal, State, and local levels and assisting efficient operation of company facilities.The incumbent is responsible for overseeing the environmental review of the cleaning of commodities at the Repair Shops.  The database currently consists of over 1300 commodities.The incumbent will also supervise the auditing of each operating location and off-site disposal facility for determining compliance with environmental regulations.  The individual will prepare for regulatory audits involving hazardous and solid waste, air emissions and wastewater discharges at all locations. The incumbent will establish, coordinate, and participate in the development of environmental procedures, training, Contingency Plans and waste disposal procedures.The incumbent’s overriding goal is to ensure Company compliance with all Federal, State and municipal air, water, and waste regulations.  The incumbent’s primary goal is the prevention of violations and penalties against the company for failure to protect the environment.The incumbent serves as the Coordinator of Marmon Rail’s Responsible Care program.  This includes the development, implementation, and maintenance of the Responsible Care Management System and any other programs required to maintain Marmon Rail’s status as a Partner in Responsible Care.Additionally, the incumbent works to epitomize Marmon Rail’s Quality Policy and ensures that subordinates work meet internal and external customer expectations at all times by fully applying himself/herself and seeing to it that subordinates apply themselves to the task involved, preventing errors, and implementing personal and departmental quality improvement projects.In order to perform the essential functions of the job, the incumbent must possess, at a minimum, the following skills and abilities:

Willingness and ability to wear safety equipment such as, but not limited to, safety shoes, safety glasses, hard hats, ear plugs, and respirators.

Ability to see and hear the visual and audio safety warnings in the facilities.

Possess vision correctable to 20/20 for inspection activities.

Willingness and ability to travel outside the normal place of work via car, train, and airplane.

Ability to lift and carry 50 pound objects.

Ability to enter tank cars via a manway opening approximately 18 inches wide and be able to tolerate confined spaces.

Ability to climb to the top of and walk on tank cars and building structures without fear of heights.

EDUCATION:This position requires a Bachelor of Science Degree in Environmental Engineering, Environmental Science or a related field and ten or more years of related experience.ESSENTIAL FUNCTIONS:

Formulates policies and procedures for the Repair Services Business Unit to ensure compliance with environmental laws and maintains indices from which potential areas of loss are identified and eliminated.

Consults with engineering department to recommend and develop the proper design, layout and usage of plant equipment to ensure existing equipment and new designs are in compliance with environmental regulations and provide maximum protection for the environment.

Coordinates environmental compliance citations in addition to providing management with advice for responding to alleged violations.

Supervises and participates in an auditing program of all Marmon Rail locations to ensure compliance with company policy and environmental regulations pertaining to hazardous and solid waste, air emissions and wastewater discharges and to determine potential vulnerabilities in order to eliminate or control them.

Directs the Company’s Responsible Care Program, providing leadership in implementing the goals and procedures of the Program to maintain the Company’s status as a Partner in Responsible Care.

Participates in and actively supports quality projects and activities to ensure that the Company achieves its goals.
