Administrative/Technical/Service
+ Responsible for Mercy's efforts to comply with Title IX, NYS’s Enough is Enough and Sexual Harassment laws, Title VI, Title VII, the ADA and Section 504, and all applicable federal and state laws that prohibit discrimination, harassment, sexual misconduct (including sexual assault and inappropriate sexual conduct), domestic violence, dating violence and stalking
+ Oversees the implementation of all policies and procedures related to harassment, discrimination, sexual misconduct, domestic violence, dating violence, stalking, accommodations, and other related policies in connection with all Mercy programs and ensures that Mercy's policies comply with all applicable state and federal laws and recommends changes accordingly
+ Supervises Assistant Director of Title IX and Equity Compliance
+ Establishes relationships with state and local agencies funded through "Enough is Enough" and collaborates with them to offer no-cost training and services to students on all Mercy campuses as well as increased awareness of sexual misconduct and its prevention
+ Works closely with Counseling Department and outside agencies to assist students involved in a Title IX or Equity matter, with mental health issues
+ Serves as the institutional custodian of all Title IX, harassment, discrimination, sexual violence reports and compliance records for internal and external reporting purposes and works collaboratively with other departments across the institution to ensure compliance and accurate data collection
+ Oversees and conducts Mercy's prevention and education efforts related to compliance with anti-discrimination policies and laws
+ Responsible for implementing the biannual climate survey, in coordination with other campus departments
+ Works collaboratively with state and federal agencies to provide information and/or respond to external investigations related to Mercy's handling of harassment, discrimination, and sexual violence matters
+ In consultation with Mercy's legal counsel, monitors legislation to ensure prompt compliance with Title IX, VAWA, Clery and federal/state anti-discrimination laws
+ Understand the state and federal laws and their requirements for upholding equal employment opportunity and affirmative action
+ Receives and investigates allegations of discrimination, including sex-based harassment, made by any member of the Mercy community. Responsible for reporting facts, findings, and recommendations to the relevant college administrator. In conjunction with the G.C.'s office, investigates charges filed with federal or state agencies and assists in the college's response to charges
+ Provides guidance and support to Office of Accessibility regarding reasonable accommodations and related matters under Mercy policy and relevant state and federal statutes, and handles appeals on accommodation requests
+ Coordinate and train volunteers to assist in Title IX investigations and hearings. Ensures volunteers perform duties in compliance with Title IX
+ Serves as a member of the University's Office of Violence Against Women (OVW) Campus Grant Coordinated Community Response Team (CCRT) As a member of the CCRT the Director works with other CCRT members to develop and enhance training and support services for University students and employees with regard to issues concerning Domestic Violence, Dating Violence, Sexual Assault and Stalking (DVSAS). The Director is required to participate in OVW trainings scheduled throughout the year as well as attend an annual out of state conference

Policies and Procedures Compliance
+ Complies with policies and procedures of the Department and the University including but not limited to the University's Code of Conduct
+ Identifies and reports gaps in policies and procedures to management
+ Complies with all required training; ensures that employees complete all required training
+ Advise and assist in establishing programs to ensure appropriate affirmative action. Ensure development and implementation of all policies, programs and procedures adhere to the EEO/AA principles and monitor them accordingly
+ Performs other duties as assigned
Qualifications
Required Skills & Experience
+ Three to five years’ experience in handling such investigations required; experience in the higher education context is strongly preferred
+ Demonstrated working knowledge of current state and federal laws, regulations, and guidance, identified best practices and trends in the field of higher education relating to antidiscrimination laws and Clery, and VAWA compliance
+ Skilled in effective investigation techniques, drafting reports of findings, and compiling, analyzing, and reporting statistical data, and ability to reach sound decisions and conclusions
+ Strong oral, written, and interpersonal communication skills, including the ability to effectively create and conduct trainings on behalf of all University constituencies and to work collaboratively with local agencies that provide support resources to the University
+ Demonstrated time management skills to complete timely investigations and reports
Education Requirements:
+ Master's Degree or JD and at least three years of experience in handling harassment, discrimination or sexual violence matters, including conducting investigations in a highly professional, sensitive and confidential manner
+ Compliance with annual training requirements for Title IX

The Mercy University Retirement Plan is comprised of two components:
Deferred Compensation Plan
All eligible employees may contribute to the Deferred Compensation Plan on a pre-tax basis upon joining the University.
Defined Contribution Plan
Eligible employees are enrolled in the Defined Contribution Plan after two (2) years of full-time employment at Mercy University and receive a semi-monthly contribution from the College, based on age and salary. If an employee is under age 36, they will receive a contribution of 3.3% of their annual salary each pay period. If an employee is age 36 or older, they will receive a contribution of 9% of their annual salary each pay period.
If employed full-time for two (2) or more consecutive years by another institution(s) of higher education (college or university), without an intervening break in service within the last twelve (12) months prior to employment before joining Mercy, please submit a waiting period waiver form to Office of Human Resources. The Defined Contribution will begin as of the first day of the month following receipt of the completed waiver form.
