What You’ll Do:

Liability Claims Examiners review property damage claims to ascertain the extent of claim exposure to the commercial motor carriers (U.S. Xpress, Inc. and Total Transportation of MS, LLC[1]).  Liability Claims Examiners review, evaluate and settle property damage claims, applying technical knowledge and relationship skills to effect fair and prompt resolutions of claims and to minimize the risk exposure to the two trucking companies.   Liability Claims Examiners proactively manage a property damage claim inventory and effectively negotiate third party transportation liability claims and/or dedicated customer liability claims.

·         Manage claim exposures from inception to completion.  Gather facts and information relating to the property damage claim from sources such as driver interviews, claimant interviews, police reports, and witness interviews. Coordinate claims-processing essentials such as initial acknowledgements, independent adjuster investigations, coverage review and decision, liability and compensability, claim loss valuation, reserving, settlement valuation and negotiation.

·         Assess liability exposure and provide claim resolution strategies and recommendations.  Knowledge of state law pertaining to concepts such as statutes of limitation, contributory negligence, comparative negligence, joint and several liability, total loss damage valuation, diminished value, loss of use, and damage mitigation.

·         Set and adjust reserves or provide reserve recommendations to ensure that reserve activities are consistent with department processes.  Pay and process claims within designated authority level.

·         Requests additional settlement authority from supervisor when case settlement value exceeds reserve limits.   Process and negotiate settlements of such claims under supervisor guidance.    Make recommendations to supervisor on disputed and high exposure claims.

·         Examine claims and, where appropriate, further reviews questionable claims to determine whether to authorize payments.  Verify and analyze data and source information used in settling claims to ensure that claims are valid and that settlements are made according to department processes.

·         Develop and continually update a plan of action, including maintaining an effective diary to bring the claim to resolution in a timely manner.  Manage claim inventory by utilizing effective diary system and documenting claim file activities consistent with department processes.

·         Develop and maintains any/all necessary documentation for claims adjudication.

·         Communicate directly with third-party claimants, shippers and dedicated customers, independent adjusters, auto appraisers, other internal claims examiners handling other aspects of a claim, and other internal business units that may have responsibility for the driver, the equipment and/or the load.

·         Act as point of contact for claimants and relevant parties to accident. Answer all questions that may arise about the claim and keeps all relevant parties up to date on status of claim.  Update all diary entries for claims and follows up on anything pending.   

·         Review invoices and/or estimates made by adjusters and/or claimants for accuracy.  Verify and assess property damages while properly managing claim expenses.

·         May assist in the defense of litigated claims by providing all supporting documents to attorneys such as witness accounts and expert testimonies.

·         Handles rebuttal claims.

·         Assist with claims reviews and audits as requested by supervisors, internal auditors and external auditors.

·         Other duties as assigned by supervisory personnel.


[1] The Risk Management Department of U.S. Xpress, Inc. handles certain claims, by agreement, for affiliated trucking company, Total Transportation of MS, LLC.  These companies have separate DOT numbers and separate management structures.
