Description of Job
DIVISION OF FIRE PREVENTION AND CONTROL
This position is located within the Division of Fire Prevention and Control.
The mission of the Colorado Division of Fire Prevention and Control is to safeguard those that live, work, learn, and play in Colorado by reducing threats to lives, property and the environment. The Division safeguards the public through: fire prevention and code enforcement; wildfire preparedness, response, suppression, coordination, and management; training and certification; public information and education; and technical assistance to local governments.
ABOUT THE WORK UNIT
The primary purpose of the work unit is to ensure that all the buildings that are included in the jurisdiction of the Colorado Division of Fire Prevention and Control (DFPC) are constructed and/or maintained in accordance with the requirements of state statutes, regulations, adopted codes, and, in the case of healthcare facilities, CMS (Centers for Medicare and Medicaid) mandated requirements. To accomplish this purpose, the work unit performs building, fire, and life safety code plan reviews and inspections, regulates licenses and certifications to ensure compliance with the statute, regulations, and the currently adopted as applicable.
WORK ENVIRONMENT
Mostly sedentary
Hybrid Model with a minimum of two days per week in the office.
ABOUT THE POSITION
This position is assigned full responsibility for the interpretation and application of enforcement
remedies/sanctions in response to deficiencies cited on licensed healthcare facility and behavioral health entity surveys and investigations; monitors facilities and agencies status throughout their period of noncompliance with federal Medicare and Medicaid participation requirements; and conducts quality assurance and quality improvement activities related to licensed healthcare facility and behavioral health entity surveys and investigations.
The position provides a unique level of expertise in the identification, selection, and application of enforcement actions in both licensed healthcare facilities and behavioral health entities. As the division expert and department senior authority, conducts education for other members of the division and Department and serves as the primary contact and resource person for providers and external stakeholders when providing information on enforcement remedies and applicable Federal and State regulations.
The Department relies on this position to interface and liaison with State level departments (e.g. Public Health and Environment - CDPHE and the Behavioral Health Administration - BHA) and the regional office of the Federal Centers for Medicare and Medicaid Services (CMS) on enforcement related issues to include remedy application and licensed healthcare facility compliance status as related to Life Safety Code enforcement. Will make recommendations to CDPHE, as the primary state CMS enforcement agency, for necessary enforcement remedies to be imposed against Certified Healthcare Facilities.
The position represents the Division and the Department in a variety of internal and external meetings, conferences, forums, and disputes in the area of enforcement of licensed healthcare facility and behavioral health entity Federal and State regulations related to fire and life safety code enforcement.
This position provides final quality assurance reviews of deficiency lists (DL) submitted by all inspectors for current healthcare and behavioral health facilities, both licensed and certified, regulated by the Division. These reviews require an in-depth assessment of the scope and severity determined by the inspector (when applicable) to ensure the appropriate level is assigned to each deficiency, ensuring the content of the deficiency appropriately matches the specific tag and regulation selected, establishing that principles of documentation were utilized when writing the deficiency, and evaluating deficiencies to confirm their legally defensible value. These reviews require a higher level of expertise and understanding of each of the unique federal and state regulations for all facilities inspected by the branch and a strong comprehension of the principles of documentation.
This position also serves to provide support and assistance in the creation and follow-up of Certificate of Compliance (COC) invoices to ensure they are accurate and that the related fees are collected in a timely and appropriate fashion. Further, this position is tasked with ensuring all information contained on a COC is accurate and up-to-date and then ensures the correct State level department has a copy of the COC for their records.
KEY RESPONSIBILITIES
Deficiency List Quality Assurance Review
This position provides final quality assurance reviews of deficiency lists (DL) submitted by all inspectors for current healthcare and behavioral health facilities, both licensed and certified, regulated by the Division. These reviews require an in-depth assessment of the scope and severity determined by the inspector (when applicable) to ensure the appropriate level is assigned to each deficiency, ensuring the content of the deficiency appropriately matches the specific tag and regulation selected, establishing that principles of documentation were utilized when writing the deficiency, and evaluating deficiencies to confirm their legally defensible value.
Administration of Healthcare Facility and Behavioral Health Entity Enforcement
Within the regulatory guidelines issued by CMS, BHA, and CDPHE, and the pertinent laws contained in the Colorado Revised Statutes, assesses facility compliance and applies necessary enforcement remedies to promote timely correction of deficient practice and sustained compliance by certified and/or licensed healthcare and behavioral health facilities in the State of Colorado. Responsibilities include analysis of the results of branch inspections, and investigations, (e.g. degree of noncompliance, supportability of the citation against the federal regulations) and facility history in the determination of appropriate remedies.
The position is responsible for tracking the enforcement case while the facility is out of compliance, this includes monitoring the status of mandatory revisits and any additional inspections effecting the facility’s compliance status; and closing enforcement cases once compliance is achieved. Participates in the division's determination of a facility’s fitness for recertification of a COC by assessing the facility’s compliance status and history; based on this assessment makes recommendations on COC action.
Certificate of Compliance COC Invoice Creation, Tracking, and Collection
This position also serves to provide support and assistance in the creation and follow-up of Certificate of Compliance (COC) invoices to ensure they are accurate and that the related fees are collected in a timely and appropriate fashion. The position tracks status of COC invoices, identifies and corrects any issues and delays, and coordinates with CDPS Accounting and Budget staff, as needed. Reviews and analyzes all COC invoices for accuracy and completeness, determines appropriate funding codes for revenues collected, and follows up on the collection of unpaid invoices.
Data Analysis and Ad Hoc Reporting
Analyzes data using multiple systems (e.g. Aspen Central Office, Aspen Reports, Salesforce) to assist in determining compliance status and prepares system defined reports for use internal and external to the division. Generates both ad hoc as well as branch and section specific reports for use in alerting team members of due and/or overdue ongoing or revisit inspections. Advises program managers of the effect on-going inspections have had or will have on agency or facility compliance status. Maintains facility enforcement data for longitudinal analysis and use by division and section personnel.
Primary Enforcement Resource, Education and Training
As the functional proponent, educates and trains division staff on Aspen system capabilities and requirements. On behalf of the Division, provides information, education, and training on enforcement related issues to consumers, advocates, division staff, other state and federal agencies (e.g. BHA, CDPHE, Colorado Board of Nursing, CMS, and the federal Department of Veterans Affairs Administration). Serves as a resource by advising others on how the enforcement process is used and any impact on other organizations. Has direct contact with facility staff, consultants, and corporate representatives to explain the effect of the federal or state enforcement system on the agency or facility. Information, education, and training is presented both in formal and informal oral presentations, as well as in written media and reports.
POC and Revisit Back-up and Support
This position serves as a back-up and support role for the inspectors related to the review of Plans of Correction (POC) and Revisits to ensure appropriate coverage and compliance with inspection deadlines.
Other Duties as Assigned
Position performs other duties as assigned or requested by the FLSS Section Chief FPB Chief, FPB Unit Chiefs, or their designees. This position often performs unusual tasks when the unique nature of the program requires it. This position acts as back-up support when appropriate for others DFPC and FLSS positions performing similar tasks (e.g., Administrative Assistant on family leave— processes out of state travel requests and books related flights, processes DPS-10 forms, etc.).
