Ensure that all injury claims are reported to Risk Management in a timely manner. Input all claims to Sedgwick via Claims Capture and notify employee and supervisor of claims number. Receive and verify workers compensation checks issued to employees who are absent from work due to on-the job injuries. Prepare workers compensation benefits checks for delivery to and deposit by the Financial Services Division. Prepare and mail letters to employees asking the employee to grant DPS the authority to endorse the benefit check on their behalf. Calculate the amount of leave to restore to employee payroll records from Workers Compensation reimbursement checks received from Sedgwick. Enter the leave buy backs into the LaGov HCM system as well as the adjustments to taxable wages due to the leave buy backs. Upon request, calculate and verify leave that was not covered under their reimbursement checks for employees engaged in law enforcement work that are disabled while in the performance of duty of a hazardous nature. Once approval has been received in witting from State Police Commission, process leave quota corrections via the La Gov HCM system to reinstate hours not reimbursed under the Worker's Compensation Indemnity Payments. Incumbents serve as the liaisons between agencies, Sedgwick, Office of Risk Management, attorneys, medical providers and injured employees. Correspond with Sedgwick by answering detailed follow-up questions on each claim. Instruct personnel in the proper procedures for reporting on the job injuries. Advise injured employees of the procedures to follow when filing claims and the rules and regulations concerning all claims submitted for processing. Initiate phone or written contact with employees, providers, and Sedgwick, as necessary, to resolve problems such as late payments, overpayments, reasons for non-payrnents, and failure of supervisors to provide timely notification of injury or return to work. Maintain contact with medical providers, employees and their attorneys, and makes all possible attempts to resolve problems. 30% FMLA Serves as the human resources FMLA subject matter expert for the administration of federally protected leave under the general direction and guidance of HR leadership and the DPS Office of Legal Affairs and in conjunction with GOHSEP'S Legal division. Interprets and administers leave programs and policies in accordance with applicable federal and state employment laws (FMLA, ADAAA, Pregnancy Discrimination Aat, Parental Leave. etc.). Develops agency policies and procedures in accordance with applicable federal and state employment laws. Provides extensive case management and coordinates all aspects of claims. Independently approves and/or denies leave cases based on relevant medical information. Communicates with health care providers and employees to obtain and establish medical facts supportingthe need for leave. Coordinates and organizes all medical information and ensures that HIPPA regulations and Employee Privacy guidelines are closely monitored and effectively executed. Evaluates all requests for leave and supporting documentation from healthcare providers to determine if other federally protected employee rights such as the ADAAA or the Pregnancy Discrimination Act may be affected. Establishes a clear line of communication with the DPS Office of Legal Affairs/GOHSEP Legal division and Human Resources leadership in these cases to evaluate relevant documentation and determine an appropriate course of action for the department. Establishes effective communication with affected employee's supervisor and time administrator to ensure all parties are in receipt of the necessary information regarding approved or denied leave requests. Works closely with the Legal to ensure compliance with all applicable state and federal laws. Coordinates with Legal and the appropriate chain-of-command to assess any work restrictions and facilitates the employee's earliest possible return to work. Manages all administrative aspects of the FMLA program including communication with employees and supervisors, monitoring of FMLA usage, and auditing of payroll entries to ensure the appropriate coding is used by time administrators and employees. Develops and administers a training program for employees and supervisors on internal FMLA policy and procedures. Counsels both employees and supervisors on the necessity of timely completion of FMLA documentation and adherence to all regulations contained in the Family and Medical Leave Act, as well as on the repercussions of failure to do so. Maintains all FMLA related paperwork in accordance with the department's retention policy. Stays up to date on FMLA related case law and applies outcomes to department policy and practice to ensure compliance at all times. 30% ADAAA Serves as the Human Resources ADAAA subject matter expert. Coordinates and work closely with DPS' Office of Legal Affairs and GOHSEP's Legal division to ensue compliance with federal and state laws, regulations, and local statutes. Independently interprets policies and procedures. Familiarizes oneself with the Office of State ADA Coordinator and takes advantage of available training and resources. Evaluates requests for accommodations and services based on the needs of the employee. Communicates with health care providers and employees to obtain and establish medical facts supporting the need for an accommodation. Coordinates and organizes all medical information and ensures HIPPA regulations and Employee Privacy guidelines are closely monitored and effectively executed. Maintains all ADAAA paperwork in accordance with the department's retention schedule. 5% MAINTTENANCE OF RECORDS Maintain files on pending, current and closed Workers Compensation cases. Compose necessary correspondence, presents evidence and testifies in defense of the department when necessary. Attend meetings and court proceedings relative to workers compensation. Recommend policy and procedure changes to management regarding the Workers Compensation program. 5% OTHER DUTIES Performs other related duties as assigned Minimum Qualifications MINIMUM QUALIFICATIONS: Three years of human resources experience; OR Six years of full-time experience in any field; OR A bachelor’s degree. EXPERIENCE SUBSTITUTION: Every 30 semester hours earned from an accredited college or university will be credited as one year of experience towards the six years of full-time work experience in any field. The maximum substitution allowed is 120 semester hours which substitutes for a maximum of four years of experience in any field.
