Legal Counsel - Privacy & Compliance

The Legal Counsel – Privacy and Compliance position will advise and counsel company executives, business units, and teams across the enterprise with regard to privacy, data security, and other statutory and regulatory requirements and matters and will serve as the Company’s privacy officer. This team member will drive development and implementation of best practices as they assist cross-functional teams in developing and implementing standards, policies, procedures, training, and initiatives and partner with appropriate stakeholders to conduct risk, impact, and similar assessments. This position reports to Associate General Counsel/Director of Legal Services and works collaboratively with all Legal Counsel.

ESSENTIAL JOB FUNCTIONS

Monitor U.S., Canadian, Mexican, and other international privacy and data security laws and regulations at the state, provincial, and federal levels. Monitor related litigation and enforcement actions, and provide relevant counsel to stakeholders across the enterprise.

Serve as the Company’s privacy officer.

Draft, review, and assist in negotiating personal data protection clauses, data processing agreements/templates, privacy notices, and other privacy-related agreements.

Partner with relevant stakeholders across the enterprise to evaluate, develop, implement, and monitor privacy, data protection and cybersecurity compliance policies, procedures, controls and/or reme

Assist in responding to subject access requests, privacy and/or compliance related audits and investigations.

Assist in the management and completion of data privacy impact and risk assessments, as well as other assessments intended to support the Company’s privacy and data protection programs.

Monitor legal and regulatory requirements, litigation, and administrative or enforcement actions impacting all areas of the Company’s business, including but not limited to consumer protection, competition, environmental, workplace health and safety, benefits, and employment, and provide advice and counsel to relevant stakeholders across the enterprise regarding the same, including assisting in drafting and updating company policies and procedures.

Develop and deliver training and communications relating to privacy, data security, artificial intelligence, and other compliance-related matters.

All other duties as assigned.

SKILLS/EDUCATION/KNOWLEDGE/EXPERIENCE/ABILITIES

Required:

J.D. from an ABA accredited law school

Active and in good standing with at least one State Bar

5+ years of legal experience, including at least 3 years of privacy and/or compliance experience

Strong analytical, problem solving, and evaluation skills

Excellent interpersonal and communication skills

Strong legal acumen with the ability to demonstrate sound judgment

Ability to work independently as well as collaboratively with business teams

Ability to manage and prioritize tasks in a dynamic, fast-paced, and often deadline-driven environment

Excellent negotiation skills

Outstanding attention to detail and accuracy

Desired:

CIPP/US certification

In-house legal experience

Litigation experience, including e-discovery, taking and defending depositions, and first or second chair trial experience

Experience in Commercial transactions or litigation
