Principal, Trade Counsel
Job Title: Principal, Trade Counsel Job Code: 21106 Job Location: Arlington, VA Job Schedule: 9/80 REG Job Description: The Principal, Trade Counsel will support the implementation and enforcement of policies to ensure compliance with U.S. trade regulations as outlined by the Department of Commerce [Bureau of Industry and Security (BIS)/Export Administration Regulations (EAR)], Department of State [Directorate of Defense Trade Controls (DDTC)/International Traffic in Arms Regulations (ITAR)], Customs and Border Protection (CBP), Department of the Treasury [Office of Foreign Assets Control (OFAC)], and any other exporting regulatory agency as required. Furthermore, this position will also guide the investigation and disclosure process related to potential violations under USG trade regulations. This position reports to the Senior Director, Trade Compliance, L3Harris Technologies. Essential Functions: + Provide guidance to L3Harris leadership related to the interpretation of various USG trade laws/regulations, including but not limited to International Traffic in Arms Regulation (ITAR) and the Export Administration Regulations (EAR), and Office of Foreign Assets Control (OFAC) + Represent the Trade Compliance function in relationship to all USG enforcement agencies + Support Trade investigations as needed and review initial and final voluntary disclosures related all violations of USG trade laws/regulations + Support the review and management of corrective actions resulting from compliance concerns + Support internal assessment programs as needed + Support due diligence assessments in regard to trade compliance for mergers, acquisitions, and/or divestitures as needed + Interpret and provide regulatory guidance to L3Harris leadership related to USG Trade regulations including but not limited to import/export transactions, 22 CFR Part 129 obligations, 22 CFR Part 130 obligations, sanctions, and anti-bribery risk + Coordinate compliance actions with Corporate Security involving any USG enforcement activities or suspicious international transactions + Support Compliance Assistance Visits to divisions/subsidiaries to assess compliance posture as needed + Coordinate compliance audits to select divisions/subsidiaries with Internal Audit as needed + 20% travel domestically and internationally Qualifications: + Bachelor's with 12 years prior export/import trade compliance experience, Graduate Degree with 10 years prior experience. In lieu of a degree, minimum of 16 years of prior related experience + JD from an ABA accredited law school and must be admitted and in good standing with a State Bar (D.C. or other) + Minimum 5 years with disclosure writings & submittals + Minimum 5 years experience with International Traffic in Arms Regulation (ITAR) and the Export Administration Regulations (EAR) + Minimum 5 experience with U.S. trade sanctions program to include Office of Foreign Assets Control (OFAC) + Ability to obtain US Secret Security Clearance Preferred Additional Skills: + Ability to interpret USG laws/regulations and assess risk management aspects + Familiarization with automated trade compliance programs + Experience with Consent Agreement + Previous assignment in military operational and/or policy positions + Technical background + Background in the Foreign Military Sales program + Familiar with other trade compliance regimes such as BATF, FDA, etc. In compliance with pay transparency requirements, the salary range for this role in Colorado State, Hawaii, Illinois, Maryland, Minnesota, Vermont and New York State is $130,500-$242,500. For California, Seattle, Washington D.C., Maryland Greater Washington D.C. area, the city of Denver, Washington State and New York City, the salary range for this role is $150,000-$278,000. This is not a guarantee of compensation or salary, as final offer amount may vary based on factors including but not limited to experience and geographic location.
