Real Estate Counsel

JOB PURPOSE

This candidate will support the business on all real estate and construction related matters for the Americas Region handled by the Legal Department in the United States. 

RESPONSIBILITIES

•    Provide business-focused legal support and advice to the Americas real estate and construction teams on all real estate and construction-related legal matters. This will include handling U.S. tenancy / lease matters, concessions, project management, wholesale fit out agreements and construction matters, as well as coordinating with local counsel in Canada, Mexico and Brazil on such matters.
•    Manage, negotiate, draft and oversee a variety of commercial real estate transactions and general commercial contract matters (while appropriately balancing Burberry commercial and reputational requirements).  This includes drafting leases, construction, and concession agreements. 
•    Assisting the business in the development, delivery and maintenance of standard lease and construction templates for the Americas and ensuring on-going compliance with current and pending legal regulation.
•    Interpret changes to US federal and state legislation relating to real estate matters (including States of NY and California), work with local external counsel on changes to local real estate and construction laws across all relevant US States and advise the relevant business teams on the potential implications to their function and any policy/practice amendments required as a result, ensuring these changes are communicated and implemented in a timely and effective manner.
•    Manage external counsel on transactions where appropriate to ensure high quality, commercially focused and cost effective legal advice.
•    Develop and provide on-going training programs for the real estate and construction teams on all related issues in the Americas.

PERSONAL PROFILE

•    J.D. from top U.S. law school
•    Must be admitted to, active and in good standing with the New York State Bar
•    5-7 years major law firm and/or corporate in-house experience with significant emphasis on real estate law, in particular advising retail tenants 
•    In-house experience would be desirable but is not essential
•    A strong working knowledge of general commercial contracts as well as multi-jurisdictional commercial real estate transactions
•    Thoughtful, proactive, strong attention to detail and organizational skills with the ability to prioritize and juggle multiple tasks
•    Effective oral and written communication and stakeholder management skills, including the ability to build an environment of trust, and influence others in a way that results in acceptance, agreement or behaviour change.
•    Understanding that legal advice goes beyond the law and has the ability to respond creatively and strategically to meet the business needs

•    Expected base salary for the role will generally be between $170,000.00 and $190,000.00 per year at the commencement of employment. However, base salary if hired will be determined on an individualized basis and is only part of the total compensation package, which, depending on the position, may also include commission earnings, discretionary bonuses, short and long-term incentive packages, and Company-sponsored benefit programs.

•    This position is at-will and the Company reserves the right to modify base salary (as well as any other discretionary payment or compensation program) at any time, including for reasons related to individual performance, Company or individual department/team performance, and market factors.
