The Florida Office of Financial Regulation provides regulatory oversight for Florida’s financial services providers. These include Consumer Finance businesses such as mortgage brokers and lenders, money transmitters, check cashers and sales finance companies. Vision Statement: The Office of Financial Regulation envisions Florida’s capital market prominence, the strengthening of its financial marketplace, and the continuous availability and dissemination of financial education tools for Floridians to aid in their financial choices while effectively protecting them from predatory practices and wrongdoing The Work You Will Do: This position is a member of the team that provides legal support to Consumer Finance, Financial Institutions, and Securities Divisions. Attorneys provide advice about licensing, examinations, and investigations. The team is also responsible for preparing administrative charging documents for violations. The team participates in the disciplinary process by negotiating settlements and litigating cases. The attorneys also provide training on various topics to Agency employees. You will also be able to participate in a number of training opportunities provided to ensure our employees have the knowledge and abilities to regulate emerging industries such as cryptocurrencies. SPECIAL NOTES: This position is being advertised Statewide and may be used to fill multiple vacancies. A Doctor of Jurisprudence degree from an ABA-accredited law school is required. Additional requirements: + Applicants are required to be members of the Florida Bar. + Two (2) or more years of professional experience in the practice of law. Preference will be given to applicants with: + Experience in administrative or financial regulatory law. + Litigation experience. + Experience in conducting investigations or depositions. Work samples may be requested to verify competence . All applicants seeking employment with the OFR are subject to mandatory background checks conducted through the Department of Financial Services (DFS), Bureau of Human Resource Management in accordance with the requirements of Chapter 435, F.S. and reviews by OFR. Applicants may be disqualified for employment with OFR based on the information that may be obtained through research and/or OFR’s review process. No applicant may begin employment until the background screening results are received, reviewed for any disqualifying offenses, and approved by the Agency. Background screening shall include, but not be limited to, fingerprinting for State and Federal criminal records checks through the Florida Department of Law Enforcement (FDLE) and Federal Bureau of Investigation (FBI) and may include local criminal history checks through local law enforcement agencies. The OFR operates from five (5) different office facilities throughout the state of Florida, including Tallahassee (Headquarters), Miami, Orlando, Tampa, and West Palm Beach. The OFR may consider any of these office locations as the primary reporting office location. This position may require 1 – 25% travel, and more depending on the selected candidate’s primary office location. A valid driver’s license is required. The anticipated salary range for this position is $60,000.00 to $75,000.00. The starting salary shall be commensurate with the selected candidate’s competencies and qualifications. Employees of the Department of Financial Services (DFS), which include employees of the OFR, are paid on a monthly pay cycle. Responses to qualifying questions must be clearly supported by the state application and any omission, falsification, or misrepresentation in the answering of the qualifying questions will be cause for immediate elimination from the selection process. MINIMUM QUALIFICATIONS FOR THIS POSITION INCLUDE THE FOLLOWING REQUIRED ENTRY LEVEL KNOWLEDGE, SKILLS, AND ABILITIES: + Knowledge and experience of Chapter 120, Florida Statutes. + Knowledge and experience with appellate, civil, and administrative litigation. + Ability to understand and apply laws, rules, regulations, policies, and procedures. + Ability to conduct research and prepare reports. + Ability to utilize problem-solving techniques. + Ability to communicate effectively orally and in writing. + Ability to work under pressure and be results oriented. + Ability to establish and maintain effective working relationships with others. + Ability to work independently and in a team environment. + Must be computer literate and familiar with Microsoft software. OTHER KSAs (Incumbent may learn on job): + Effectively utilize agency hardware and software programs including proficient utilization of the REAL system. BRIEF DESCRIPTION OF DUTIES : Renders legal advice and counsel to agency personnel on OFR policies and regulations, legislative matters, statutory interpretations, and rule promulgation, which require significant legal experience and the exercise of independent judgment. Drafts contracts, proposed orders, declaratory statements, written agreements, correspondence, and other related documents regarding matters within the jurisdiction of the OFR or determines compliance with applicable state and federal laws as to documents drafted by others. Conducts independent and varied legal research requiring sound legal analysis and the exercise of independent judgment in evaluating state statutes, federal statutes, and constitutional issues. Subsequent to research, will prepare legal opinions and memoranda for use throughout the OFR. Provides cooperation and assistance to Assistant State Attorneys, Assistant Statewide Prosecutors, Assistant U.S. Attorneys and law enforcement agencies concerning criminal enforcement matters which may result from investigations conducted by the OFR into alleged violations of the state banking, securities, and finance laws or related statutes and provides assistance and cooperation to other state and federal governmental agencies concerning civil or administrative actions related to alleged violations of matters within the jurisdiction of the OFR.
