Yes County Schenectady Street Address 401 State Street City Schenectady State NY Zip Code 12305 Duties Description The Assistant Counsel will perform the following duties: • perform difficult professional legal work in the analysis and interpretation of laws related to the work of a State agency and in the development of the agency’s legislative program:• prepare, assemble and analyze evidence in cases to be heard by administrative bodies; • attend hearings; • prepare legal memoranda and findings of fact with respect to administrative decisions; • personally conduct and direct investigations; • assist in the study, review, revision and preparation of the rules and regulations promulgated by State agencies; • assist in the drafting and review of proposed legislation; • assist in the preparation of findings and recommendations, prepare replies to correspondence on complicated questions of law; • review documentation submitted in response to agency communication: including legal analysis of enabling and procedural statutory requirements, and preparation of documentation to substantiate such legal analysis Minimum Qualifications *This title is part of the New York Hiring for Emergency Placement Statewide Program (NY HELPS). Current New York State Justice Center employee with one or more permanent, contingent-permanent or 55b/c service as a Senior Attorney and are interested in reassignment; OR current New York State employees with one year or more of permanent, contingent-permanent or 55b/c service in a position at SG-23 or above and eligible for transfer under section 70.1 of the Civil Service Law. Non-Competitive Minimum Qualifications; Senior Attorney Minimum Qualifications: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience. (Equated to salary grade 25: $90,931-$114,940). Assistant Attorney 1 Minimum Qualifications: Law School Graduation (or other eligibility to take the NYS Bar Examination). (Equated to salary grade 18: $65,164-$80,860).Assistant Attorney 2 Minimum Qualifications: Admission to NYS Bar. (Equated to salary grade 20: $72,160-$89,332). Assistant Attorney 3 Minimum Qualifications: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience. (Equated to salary grade 22: $80,138-$98,882).Advancement Within the Legal Traineeship: If you are appointed to one of the entry levels of the Attorney Traineeship, you will normally be advanced after each twelve months of satisfactory service to the next higher title (with salary based on performance) until you reach the full performance level of a Senior Attorney.If you are appointed as an Assistant Attorney 1, you will be automatically advanced to Assistant Attorney 2 upon admission to the New York State Bar. If you are not admitted to the New York State Bar within two years of appointment, your appointment will be terminated.If your final performance evaluation as an Assistant Attorney 2, and your six-month performance evaluation as an Assistant Attorney 3, are rated outstanding, you may be eligible for early advancement to Senior Attorney, reducing your traineeship by six months. Similarly, if your final performance evaluation as an Assistant Attorney 2, and your six-month performance evaluation as an Assistant Hearing Officer are rated outstanding, you may be eligible for early advancement to Hearing Officer, reducing your traineeship by six months. Additionally, this would apply to all titles filled from the Legal Specialties traineeship.All service during the traineeship will be in probationary status. Performance will be evaluated every six months against established standards set by the individual agencies which reflect a timetable for gaining the knowledge and skills necessary so that appointees are able to function at the Senior Attorney level at the completion of the traineeship.For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in an NY HELPS title, employees may take part in any promotion examination for which they are qualified.
