Duties Description Under the direction of the Associate Attorney, the incumbent will conduct investigations of Board-authorized treating providers and Independent Medical Examiners and make recommendations as to administrative action, if any, to be taken regarding such providers. Duties include, but are not limited to, the following:• Investigate cases of potential health care provider misconduct, with an emphasis on situations involving allegations of inadequate and/or negligent care provided to injured workers. • Work with Adjudication Services to identify patterns of misconduct in pending claims and assist in drafting and implementing standard abbreviations to be used in decisions to describe these patterns.• Take and evaluate referrals from the Medical Directors Office, NYS Inspector General, Workers’ Compensation Law Judges, claimants, and the public regarding potential medical provider misconduct. • Working with the Legal Assistant 2, prepare and conduct initial investigations of medical providers, including comprehensive audit and review of Case Information System data, billing documentation, and authorization file material. Determine if administrative action, such as administrative warning, removal, revocation or temporary suspension of a provider’s authorization is warranted. Recommend referrals of medical providers to the NYS Department of Health, State Education Department, and Inspector General, as appropriate.• Prepare interrogatories, notices of deposition, and formal correspondence to be sent to medical providers and their counsel.• Represent the Board during depositions and informal (non-hearing) proceedings.• Serve as prosecutor in any formal hearing process to temporarily suspend or revoke medical providers. Ensure that proper process is followed, and that a formal record is kept and maintained. Request the hearing officer to make recommended findings of fact and conclusions of law to the Chair. If administrative appeal is then sought by the provider, prepare and submit all necessary and relevant briefs and documentation in support of the requested findings.• Liaison with NYS Attorney General in the defense of Article 78 proceedings commenced by a suspended, removed, or revoked medical provider, including preparation of necessary answers, defenses, affidavits, and any and all other motion or trial practice materials.• Advise the Medical Director’s Office as to provider authorizations, including whether there is any legal basis to deny authorization.• Make recommendations to the Associate Attorney or other supervisors regarding regulations and potential statutory reform of the medical discipline process.• Participate in special legal projects regarding rules and regulations, legislation, and other special assignments at the request of the Associate Attorney or other supervisors, including procedures, subject numbers, bills, forms and charts.
Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making permanent non-competitive appointments and the official probationary period will begin.At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected. NON COMPETITIVE MINIMUM QUALIFICATIONSAssistant Attorney 1- Starting Salary $65,001- Must be Law school graduation and/or eligibility for NYS Bar AdmissionAssistant Attorney 2- Starting Salary $72,032- Admission to NYS BarAssistant Attorney 3- Starting Salary $79,928- 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experienceSr. Attorney- Starting Salary $93,530- 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.55 B/C QUALIFICATIONS:Individuals certified eligible for the 55b/c program under the Governor’s Program to Hire Persons/Veterans with Disabilities pursuant to Section 55b/c of the Civil Service Law will also be considered. To be considered, you must meet the minimum qualifications and provide a copy of your letter of eligibility with your response. Candidates must meet the non-competitive minimum qualifications listed above.TRANSFER QUALIFICATIONS:Candidates must have one year of permanent competitive or 55 b/c service in a title designated as appropriate for transfer in accordance with Section 52.6, 70.1 OR 70.4 of the Civil Service law.70.4 transfer candidates must have one year of permanent competitive service in a position allocated to a SG-16 or higher and possess a bachelor’s degree and have standing on the Legal Specialties exam list.
