Purpose

Contributes to the overall success of the Scotia Securities Inc. (SSI) / Global Compliance GWM in Canada ensuring specific individual goals, plans, initiatives are executed / delivered in support of the team’s business strategies and objectives.  Ensures all activities conducted are in compliance with governing regulations, internal policies and procedures.

Participates in investigating and assisting with internal and regulatory investigations in accordance with regulatory requirements (in particular those established by securities regulations and Self-Regulatory Organizations (SROs), including the Investment Industry Regulatory Organization of Canada (IIROC) and The Mutual Fund Dealers Association of Canada (MFDA)) for various wealth management entities within Scotiabank. 

Performs investigations and documents clearly reasoned findings and actions associated with Head Office investigations, along with the delivery of timely disposition of such investigations to the Senior Managers and Chief Compliance Officer.

Participates in a team supporting 2nd line compliance oversight and investigations of the SSI Global GWM activities. Ensuring the Global Wealth Business line is compliant with legal and regulatory requirements and adherence to internal policies and procedures. This includes responsibility for investor and institutional protection and transparency, conflicts of interest, market abuse, control room policies, information barriers, monitoring of personal trading and other conduct initiatives.

Champions a customer focused culture to deepen client relationships and leverage broader Bank relationships, systems and knowledge.

Understand how the Bank’s risk appetite and risk culture should be considered in day-to-day activities and decisions.

Actively pursues effective and efficient operations of his/her respective areas in accordance with Scotiabank’s Values, its Code of Conduct and the Global Sales Principles, while ensuring the adequacy, adherence to and effectiveness of day-to-day business controls to meet obligations with respect to operational, compliance, AML/ATF/sanctions and conduct risk.

Assess, analyze, and report on Head Office Investigations (HOI) as assigned, including:

Determine the issues; 

Research client records, trade activities, and account information to determine whether there may be a breach of policies and procedures or other regulatory infractions.

Obtain and perform a detailed analysis of available information, including Corporate Security's investigative report, account documentation, file notes, complaints files, and other internal departments' documentation for further details as required;

Prepare and review findings for presentation to management.

Apprise management of the status of ongoing investigations and findings.

Prepare an HOI report and review the findings for presentation to management.

Recommend risk mitigation actions and next steps after the investigations

Handle Provincial/National/SRO Regulators inquiries effectively in a timely manner, including METS submissions

Promote good relations with Provincial/National/SRO Regulators and BNS Internal Audit

Prepare materials in response to regulatory inquiries, examinations, and investigations and assist legal counsel as required in preparing cases for arbitration, SRO disciplinary proceedings, or civil litigation. - Assist Senior Manager with the coordination/management of any examinations or investigations, and coordinate as requested, input into any proposed new or amended regulation.

Assist with managing the incoming mailbox when necessary.

Maintain and update various logs for the regulatory inquiries when necessary. 

Evaluate and make recommendations for the development/enhancement/clarification of policies, practices, procedures, and/or systems changes necessary to support ongoing compliance, including developing and recommending policy and procedure changes based on complaint experience and regulatory events to correct incidents of non-compliance (and prevent their reoccurrence) and weaknesses in policies, practices, procedures, systems and/or training.

 

Education/Experience

 

An Undergraduate University Degree (preferably in business or accounting

At least 3-5 years related work experience in the securities industry

Relevant industry proficiencies; (Canadian Investment Funds Course (or equivalent), IFSE Branch Managers Examination (or equivalent);

The completion of industry courses is required within 12 months of hire

The incumbent is expected to have superior English writing proficiency and at least 5 years of work experience in the investment funds industry.

Advanced knowledge of Microsoft applications (including Word, Excel, and PowerPoint) and familiarity with the internet and related applications as tools for conducting compliance related research.

The incumbent must have a thorough, current knowledge of Regulations applicable to the sale and distribution of Mutual Funds, including CSA National Instruments and MFDA Rules and Policies.

Ability to evaluate risk, to identify control weaknesses, to contribute to the development of policies, to implement supporting procedures, and to report on non-compliance effectively.

Skills including sound judgment, communication, and people skills to effectively interact with staff, branches, and regulators. Effective reporting to senior management is also a critical component of the job
