ROLE OVERVIEW
We are looking for an experienced Senior Legal Counsel with extensive experience in consumer law and financial services regulation.
The Senior Legal Advisor is responsible for:
the creation and management of customer terms and conditions (retail and SME) with a focus on simplification and plain language;supporting the business with practical, customer centric legal advice regarding legislation applicable to the banking environment.drafting, review and negotiation of various commercial agreements that a bank may conclude with third parties.The senior legal advisor reports directly to the Head of Legal.
KEY RESULT AREAS
Draft, review, update and manage customer facing terms and conditions (retail and SME);Support the business in ensuring that their terms and conditions comply with legislation relevant to the banking industry;Provide specialist legal advice and legal solutions to all relevant business areas;Monitor changes in legislation and case law and provide effective legal advice to impacted stakeholders;Provide support to stakeholders regarding customer complaints;Identify and effectively communicate current and anticipated legal risksCommunicative and proactiveROLE REQUIREMENTS
Expert knowledge on consumer law and financial services regulation, particularly, the NCA, CPA, POPIA, FICA and FAIS.,8 years legal experience in Retail / SME banking;Experience in conducting legal research and formulating sound legal opinions;Payments law experience would be beneficial;Experience in providing legal advice on product development, customer communications and marketing; Admitted attorney in South AfricaThe appointment will be made from the designated group in line with the Employment Equity Plan of Old Mutual South Africa and the specific business unit.
This role assists the Group Company Secretary in providing a professional company secretarial and company administrative service to the South African group of companies, committees and trusts. The incumbent should (for its portfolio), and across the larger group, influence decisions with strategic intent, driving best practice corporate governance to ensure the sustainability of the organisation and is individually accountable for achieving results through staff.ResponsibilitiesLegalManage the provision of a significant legal service specialty.
Document PreparationDevelop and write materials that are highly visible, such as sensitive press releases or speeches to critical audiences.
Information and Business AdviceProvide specialist advice on the interpretation and application of policies and procedures, resolving complex or contentious queries and issues and enabling others to take appropriate actions.
Internal Client Relationship ManagementManage relationships with internal clients and act as a business partner to them, building high levels of professional credibility and mutual trust, and managing the deployment of appropriate internal and/or external resources to support in delivering business strategy and plans.
Leadership and DirectionIdentify and communicate the actions needed to implement the function's strategy and business plan within the business area or department; explain the relationship to the broader organization's mission, vision, and values; motivate people to commit to these tenets and do extraordinary things to achieve local business goals.
External CommunicationsDevelop and/or deliver a plan for significant aspects of external communications with guidance from senior colleagues.
BudgetingDevelop and/or deliver budget plans with guidance from senior colleagues.
Performance ManagementManage and report on the performance of a substantial, diverse team; set appropriate performance objectives for direct reports or project/account team members and hold individuals accountable for achieving them; take appropriate corrective action where necessary to ensure the achievement of team/personal objectives.
