Circle K is seeking a talented Sr. Litigation Counselor to join the U.S. Legal Team reporting to the Head of Legal Affairs, USA. The selected candidate will have discerning judgment and provide legal and administrative support on litigation matters in the U.S. and provide direct management of outside panel. The ideal candidate is determined, self-motivated, organized, detail-oriented, proactive, and committed to assisting us to meet all of the Company’s litigation needs. In addition to the litigation focused role of this position, additional weight will be given to those candidates that have experience in other subjective matter areas such as contract review and negotiation, marketing, procurement and data privacy.
The Job Responsibilities for this position will include:
Corporate Litigation Matters
• Assist U.S. Head of Legal with corporate litigation and management of outside panel counsel.
• Independently manage a portfolio of corporate litigation matters.
• Help with the development of programs and policies to reduce exposure to general liability (and other) claims.
• Support litigation and other adversarial matters in close partnership with internal legal and business teams as well as outside counsel.
• Assist with development, presentation and training on litigation and compliance matters.
• Manage environmental disputes and litigation, support Environmental team with access agreements and indemnity agreements, support Facilities in fuel site closures and environmental remediation; work to reduce penalties for non-compliance
• Regularly interface with counsel to support discovery and investigations.
• Play a key role in supporting the litigation team’s handling of complex material litigation matters, subpoena responses, and pre-litigation matters.
• Conduct interviews, draft affidavits and otherwise assist in the preparation of correspondence, documents and reports.
• Work collaboratively with litigation and e-discovery teams to assist in case management.
• Summarize complex legal documents/cases.
• Perform other functions such as conducting research, proofreading, organizing and maintaining forms, databases and other materials.
• Perform other duties as assigned.
Asset Recovery/Collections
• Work primarily with Wholesale, Accounting and Risk Management teams to identify assets to be recovered by CK and related entities.
• Work within parameters of the debt collection model and modify as necessary.
• Draft demand letters to targets.
• Serve as integral part of collectability analysis.
• Track matters and participate in weekly update calls with outside counsel.
• Provide feedback to business teams to keep them informed of matter progress and budget spend.
• Participate in regular updates to keep relevant departments apprised on recovery effort progress for financial reporting to management
• Draft/review settlement documents – releases, notes, letter agreements as necessary.
• Manage/enforce settlement payments and follow up as needed.
ADA Title III
• Intake complaints and identify whether CK owes/is owed indemnification in the action
• Track open cases and hold regular update calls with outside counsel.
• Work with relevant departments to have site inspection completed.
• Liaise with outside counsel to negotiate the terms of the settlement agreement.
• Obtain proper sign offs for remediation costs and any settlement payments.
• Inform facilities of deadline to complete mediation.
• Monitor remediation deadlines to ensure compliance with settlement agreement terms.
Qualifications
Licensed to practice law in one or more states (in good standing).Preference given to applicants with experience handling ADA Title III claims.Minimum 5 years' experience, preferably at an insurance defense firm or in-house insurance claims department.Experience with Relativity eDiscovery platform a plus.Ability to think critically and make clear and well-reasoned decisions.Meticulous attention to detail and strong organizational skills.A team player that can work in a highly collaborative matrixed environment and influence people and decisions without direct authority.Time management, prioritization, and interpersonal skills with the ability to partner with all levels of management and business teams.Demonstrated ability to maintain the highest level of confidentiality acting with integrity and discretion.Ability to work across functions to get the job done with a sense of urgency.Thoughtful and creative problem solving.Ability and patience to develop relationships across the organization.Excellent project management skills and commitment to seeing tasks through to completion.Strength of character to take and sustain difficult positions; able to say no or push back without alienating others.High level of energy and enthusiasm.A spirit of continuous improvement.##LI-GE1
